Terms of Service

These Terms of Service ("Terms") govern your access to and use of ZeroLapse ("the Service"), provided by ZeroLapse ("we", "us", or "our"). By registering for or using the Service, you agree to be bound by these Terms.

1. Description of Service

ZeroLapse is a cloud-based HSE (Health, Safety and Environment) training and certificate management platform that allows organisations to track employee certifications, PPE issuance, asset compliance, and related health and safety records.

2. Account Registration

To use the Service, you must register for an account and provide accurate, complete information. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorised use of your account.

3. Subscription Plans and Payment

ZeroLapse offers subscription plans billed monthly or annually. By selecting a plan, you authorise us to charge your nominated payment method on a recurring basis. All fees are quoted in South African Rand (ZAR) and are exclusive of VAT where applicable.

A 30-day free trial is available for new accounts. No payment is required during the trial period.
After the trial period, continued access requires a valid subscription.
Subscription fees are non-refundable except where required by South African consumer law.

4. Acceptable Use

You agree not to:

Use the Service for any unlawful purpose or in violation of any applicable laws
Upload false, misleading, or fraudulent compliance records
Attempt to gain unauthorised access to any part of the Service or its infrastructure
Resell, sublicense, or commercially exploit the Service without our written consent
Interfere with or disrupt the integrity or performance of the Service

5. Data and Privacy

Your use of the Service is also governed by our POPIA Data Agreement, which is incorporated into these Terms by reference. We collect and process personal information in accordance with the Protection of Personal Information Act (POPIA) of South Africa. By using the Service, you consent to such processing as described in our POPIA Data Agreement.

6. Data Ownership

You retain ownership of all data you upload to the Service. We do not sell your data to third parties. You may export or request deletion of your data at any time by contacting us at info@zerolapse.co.za.

7. Service Availability

We strive to maintain high availability of the Service but do not guarantee uninterrupted access. We may perform scheduled maintenance with reasonable advance notice. We are not liable for any loss or damage resulting from downtime or service interruptions beyond our reasonable control.

8. Limitation of Liability

To the maximum extent permitted by law, ZeroLapse shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of or inability to use the Service. ZeroLapse is a compliance management tool and does not replace the professional judgement of qualified HSE practitioners. You remain solely responsible for your organisation's compliance with applicable health and safety legislation.

9. Cancellation and Termination

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. We reserve the right to suspend or terminate your account if you breach these Terms, with or without notice.

10. Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes by email or via the Service. Continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.

11. Governing Law

These Terms are governed by the laws of the Republic of South Africa. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the South African courts.
